Background Workplace Incivility is a common issue in the nursing profession. Nurses who are affected by such behaviors may experience distress. Objectives This study aimed to assess the relationship between workplace incivility and nurses’ professional quality of life. Research design This cross-sectional correlational study was conducted in 2021 in “Tehran”. Data were collected using a demographic questionnaire, the Nursing Incivility Scale (NIS), and the Professional Quality Of Life scale (ProQOL). Data analysis was performed through the Pearson correlation and multiple linear (...) regression, using the SPSS v.16. Participants and research context Participants were 200 nurses randomly recruited from selected hospitals of “TUMS”. Ethical considerations The study obtained research ethics approval and all participants were informed of the voluntary and anonymous nature of their participation. Findings The mean age of participants was 32.30 ± 7.22, and 76.5% were female. There was a significant correlation between the professional quality of life and workplace incivility ( r = −0.23, p =.001). Multiple regression analysis between the subscales of workplace incivility and professional quality of life demonstrated that the incivility from the supervisor ( β = −0.29, p =.001) and incivility from patients ( β = −0.27, p <.001) can predict the compassion satisfaction dimension. The incivility from the supervisor ( β = 0.24, p =.001) and incivility from patients ( β = 0.26, p <.001) can explain burnout. The incivility of the patients can explain secondary traumatic stress ( β = 0.14, p =.02). Conclusion This study showed that workplace incivility is significantly related to professional quality of life. Therefore, the reduction of behaviors of incivility can lead to the improvement of the professional quality of life. (shrink)

Precipitation deficit causes meteorological drought, and its continuation appears as other different types of droughts including hydrological, agricultural, economic, and social droughts. Multivariate Standardized Precipitation Index can show the drought status from the perspective of different drought types simultaneously. Forecasting multivariate droughts can provide good information about the future status of a region and will be applicable for the planners of different water divisions. In this study, the MLP model and its hybrid form with the Imperialistic Competitive Algorithm have been (...) investigated for the first time in multivariate drought studies. For this purpose, two semi-arid stations of western Iran were selected, and their precipitation data were provided from the Iranian Meteorological Organization, during the period of 1988–2017. MSPI was calculated in 5-time windows of the multivariate drought, including MSPI3–6, MSPI6–12, MSPI3–12, MSPI12–24, and MSPI24–48. The results showed acceptable performances in forecasting multivariate droughts. In both stations, the larger time windows had better predictions than the smaller ones. Generally, it can be reported that, by decreasing the size of the time window, the gradual changes of the index give way to sudden jumps. This causes weaker autocorrelation and consequently weaker predictions, e.g., forecasting droughts from the perspective of soil moisture and surface hydrology simultaneously. The hybrid MLP-ICA shows stronger prediction results than the simple MLP model in all comparisons. The ICA optimizer could averagely improve MLP’s accuracy by 28.5%, which is a significant improvement. According to the evaluations, the results are hopeful for simultaneous forecasting of different drought types and can be tested for other similar areas. (shrink)

Evapotranspiration represents the water requirement of plants during their growing season, and its accurate measurement at the farm is essential for agricultural water planners and managers. Field measurements of evapotranspiration have always been associated with many difficulties that have led researchers to seek a way to remotely measure this component in horticultural and agricultural areas. This study aims to investigate an indirect approach for daily rice crop evapotranspiration measurement by machine learning techniques and the least available climatic variables. For this (...) purpose, daily meteorological variables were obtained from three ground meteorological stations in rice cultivation regions of northern Iran during 2003–2016. The ETc rates were calculated by seven meteorological variables, the FAO-56 Penman-Monteith equation, and the regional calibrated rice crop coefficient and considered as the reference data. The MLs, including Multilayer Perceptron, Radial Basis Function, Generalized Regression Neural Network, and Group Method of Data Handling, were utilized for ETc modeling. Different input combinations were applied, based on the use of minimum effective variables as input. Results showed that the models showed the most accurate performances in the input combination of four climatic variables: sunshine duration, maximum temperature, relative humidity, and wind speed. Investigating the accuracy of models in rice growth phases showed that the least estimation error belonged to the initial growing stage, which increased during the mid-season and late-season growing stages. A comparison of the models showed that the GMDH model performed better against the other competitors. For this model, both the Nash-Sutcliffe coefficient and R2 were greater than 0.98, and the Root Mean Square Error ranged between 0.214 and 0.234 mm per day in all stations. The current approach showed promising results in rice evapotranspiration modeling by only four common meteorological variables and can be reliably applied for indirect measurement of this variable over the rice farms. The studied approach will have research value for rice and other crops in similar/different climatic conditions. (shrink)

We report on the simultaneous determination of complementary wave and particle aspects of light in a double-slit type “welcher-weg” experiment beyond the limitations set by Bohr’s Principle of Complementarity. Applying classical logic, we verify the presence of sharp interference in the single photon regime, while reliably maintaining the information about the particular pinhole through which each individual photon had passed. This experiment poses interesting questions on the validity of Complementarity in cases where measurements techniques that avoid Heisenberg’s uncertainty principle and (...) quantum entanglement are employed. We further argue that the application of classical concepts of waves and particles as embodied in Complementarity leads to a logical inconsistency in the interpretation of this experiment. (shrink)

With an estimated 10–15% of couples in the country that are infertile, there are not any legal or religious barriers that prohibit an infertile couple from taking advantage of Assisted Reproductive Technologies (ARTs). Although all forms of ARTs available in Iran have been legitimized by religious authorities, there is a lack of legislation in all ARTs except embryo donation. By highlighting ethical issues in embryo (...) donation, the paper presents a critical review of the Act of Embryo Donation in Iran. The paper argues that the Act does not provide enough safeguards for the future child and assurance for the safety of the donated embryos. It also does not restrict embryo donation to surplus embryos from infertile couples and is silent about the number of embryos that could be donated by each couple as well as the number of recipients for donated embryos by a couple. The Act is also silent about the issues of genetic linkage (nasab) and heritage which are challenging issues, especially in a conservative Islamic society. As a result, the future child may not inherit from their birth parents, as it is not required by the Act, or from the genetically related parents under the anonymity policy. Finally there is no standard national protocol or guidelines to evaluate the safety of the donated embryos. With the shift toward online environments due to COVID-19 pandemic, particularly for educational sector, employees’ performance has been affected by an array of different factors. Personal aspects as well as organizational focus on individuals’ wellbeing are the main focus of this study through inclusion of job autonomy and work-life conflict alongside other factors, such as informational support that can aid academic staff regarding their wellbeing during times of crisis. In response to the effects of COVID-19 on employees, this study aims (...) to provide tangible data to protect university teachers during crises and establish key points that can improve their wellbeing. For this purpose, we used interviews to provide in-depth understanding of the subject. A total of 16 teachers as interviewees have provided qualitative data that was analyzed with MAXQDA. This study highlights the importance of work-life conflict and vitality of job autonomy on academic staffs’ performance and overall wellbeing through a conceptual analysis. We emphasize the role of organizations in maintaining a work environment where university teachers’ wellbeing is prioritized and various elements such as training and support are used to help stabilizing work-life balance. The current findings can be beneficial for both scholars and decision-makers in schools and universities to enhance elements of remote work for their staff. (shrink)

The U.S. oversight system for genetically engineered organisms was evaluated to develop hypotheses and derive lessons for oversight of other emerging technologies, such as nanotechnology. Evaluation was based upon quantitative expert elicitation, semi-standardized interviews, and historical literature analysis. Through an interdisciplinary policy analysis approach, blending legal, ethical, risk analysis, and policy sciences viewpoints, criteria were used to identify strengths and weaknesses of GEOs oversight and explore correlations among its attributes and outcomes. From the three sources of data, hypotheses and broader (...) conclusions for oversight were developed. Our analysis suggests several lessons for oversight of emerging technologies: the importance of reducing complexity and uncertainty in oversight for minimizing financial burdens on small product developers; consolidating multi-agency jurisdictions to avoid gaps and redundancies in safety reviews; consumer benefits for advancing acceptance of GEO products; rigorous and independent pre- and post-market assessment for environmental safety; early public input and transparency for ensuring public confidence; and the positive role of public input in system development, informed consent, capacity, compliance, incentives, and data requirements and stringency in promoting health and environmental safety outcomes, as well as the equitable distribution of health impacts. Our integrated approach is instructive for more comprehensive analyses of oversight systems, developing hypotheses for how features of oversight systems affect outcomes, and formulating policy options for oversight of future technological products, especially nanotechnology products. U.S. approaches to oversight of research and technological products have developed over time in an effort to ensure safety to humans, animals, and the environment and to control use in a social context. In modern times, regulatory and oversight tools have evolved to include diverse approaches such as performance standards, tradable allowances, consultations between government and industry, and pre-market safety and efficacy reviews. The decision whether to impose an oversight system, the oversight elements, the level of oversight, the choice of (...) approach, and its execution can profoundly affect technological development, individual and collective interests, and public confidence in technological products. Oversight is conducted by a range of institutions with various capabilities, cultures, and motives. Avenues for disputing oversight decisions are also important, and some argue that the U.S. operates in an adversarial regulatory culture in which Congress, the media, and stakeholders regularly contest the decisions of federal agencies. This work was presented at the Research Center for Philosophy of Science of the Ferdowsi University of Mashhad (Iran) – in Aug 2020. --- -/- Briefly, in the first section of this Persian book, first of all, I (Hereafter: the writer) have presented generalities of Aesthetics and an interpretation of aesthetic universality (Hereafter: φ) and it is argued that each definition of art has to admit φ and this is a Kantian, minimalist, and subjective perspective view (some others would incline (...) objective interpretation of φ, but it is beyond the purpose of this work). What’s more, this view could be applied to all definitions of art e.g. Functionalism, Conventionalism, or Hybrid Theories. Additionally, the writer has replied to some objections, those would promote definitions of art without φ, it seems that they could not be successful to refuse φ, since it appears that φ is a premise in every aesthetic judgment. Next, in another section, the writer has written some primary notes on creativity, those have come from contemporary literature of it, and it is argued that there is a relation between creativity and φ. It is also claimed that the relation is the same φ by the creative processes, creative products, and creative persons, both scientifically and philosophically; and so, the relation represents that φ is true. Besides that, the writer has presented some potential objections to the writer’s aspect of the relation and the writer has also replied to those objections. --- -/- In the next section of the book, the writer has applied the φ by creativity to the philosophy of animal-made art, the writer revolutionarily illustrates that first of all, the normativity of the philosophy of animal-made art is prior to the descriptive one. Second of all, φ is principally the criterion to know that animal-made art is impossible. The writer’s position recognizes those other works of animal aesthetics, which means aesthetics of all of the non-human creatures in the earth or cosmos as a new part of environmental aesthetics, is the marginally second order of animal aesthetics. It is owing to the fact that first of all, the question, of whether animal-made art is possible or not, is normative. Second of all, if one does not concern normativity of the question, then one could not get the answer to the nature of it. Next, one could not distinguish between on the one side, the pleasure of drinking water when one’s thirst may cause death, on the other side, the one’s pleasure of listening to music when there is no urgent necessity of it. The fourth argument is that one needs to identify the normativity of animal-made art because one could generalize aesthetic judgments if one sets φ as the basis of it, and then, one identifies that φ is one of the most fundamental bases in Aesthetics. --- -/- The main section of this book is that the writer’s argument -Animal-Made Art Impossibility Argument- is in favor of the impossibility of animal-made art i.e. Functionalist, Conventionalist, or Hybrid Theories of the definitions of animalmade art, also the writer has replied to some possible ideas and objections to the argument. --- -/- Pouya Lotfi Yazdi --- Iran | June 2022. Surface acting is a heavy emotional and cognitive task practiced by nurses, which has negative consequences on their wellbeing. The shortage of nurses along with the occurrence of the COVID-19 pandemic has worsened the situation. Based on job demands-resources and conservation of resources theories, this study aims to investigate the adverse impact of practicing SA and buffering effect of a sense of community on job stress and cognitive weariness among Iranian nurses confronting COVID-19. As this study is written within the (...) scope of Frontiers’ call for research on “Spirituality in the workplace,” the findings suggest that the aforementioned factors are in significant positive relationships. Furthermore, the empirical evidence indicates that there is a significant indirect effect of SA on CW through JS. In addition, results reveal that there is a buffering effect of SOC on the SA and JS relationship, while there is no significant moderation effect regarding the JS and cognitive weariness association. The findings of this study provide theoretical and practical implications within the scope of spirituality in the workplace. (shrink)

Medical ethics is a practical key element in the medical curriculum. Movies can be used as an effective and innovative way to involve students in discussions and reflections on ethical issues. This study aimed to evaluate the appropriateness of medical movies as a tool in medical ethics education. During the last teaching session of the medical ethics courses, the movie “Extreme Measures” was shown to the medical students. The present study is a descriptive-analytical study of 302 students’ manuscripts. The quantitative (...) content analysis of the students’ manuscripts was carried out using a checklist that contained 11 titles and 75 subtitles. Each student’s checklist was compared to the student’s final exam score. The most recognized issue was justice, and the least recognized one was confidentiality and privacy. Nonmaleficence, respecting autonomy and informed consent, honor and integrity, end of life, duty and responsibility, conflict of interest, beneficence, relationship with colleagues and altruism were located in-between. There was a relationship between students’ final exam scores and their manuscripts’ scores. According to our findings, relevant movies with standard categorization can be used as a useful method for medical ethics education and assessment. (shrink)

By bringing together ideas from across the world, the exhibition presents itself as a platform for exchange and experimentation and strives to stimulate an engaging dialogue that is inclusive of all voices. The aim of this study is to examine the factors influencing ethical business decision-making on environmental issues, among employees of SMEs. To do so, a survey study was performed with 394 top managers of SMEs in the UAE using a questionnaire, and the data was statistically evaluated using SmartPLS 3.0. The results suggest that prior technology use has significant positive relationships with ethical decision-making and the level of risk acceptance. Furthermore, perceived competitive pressure has significant positive relationships with ethical decision-making (...) and confidence level. In comparison, the level of risk acceptance and confidence level have significant positive relationships with ethical decision-making. Results also demonstrate that the level of risk acceptance mediates the relationship between prior technology use and ethical decision-making. There is also a significant and positive association between perceived competitive pressure and ethical decision-making with a mediating impact of the confidence level. (shrink)

Individuals working in different industries were forced to change their work environments to their homes and quickly cope with technical and social changes not experienced before the occurrence of COVID-19 pandemic. This led to blurred boundaries between work and family roles, diminishing performance and wellbeing. Within the scope of the Research Topic “Workplace effects of COVID-19 on employees,” this research emphasizes on the positive impact of job autonomy provided by employers in reducing work-family conflicts. Moreover, the effect of work-family conflict (...) on employees’ performance and wellbeing is analyzed. Furthermore, informational support is examined regarding its moderating effect to mitigate work-family conflicts and enhance wellbeing. A survey was administered among employees of small-medium enterprises in Lebanon, through purposive and convenience sampling with 198 participants. The data was analyzed using PLS-SEM, and the results show that job autonomy reduces work-family conflict. This in turn improves performance and wellbeing as individuals have more control on their tasks. Furthermore, informational support provided to the employees serves as a buffer between work-family conflict and wellbeing. These results can be beneficial for managers of small and medium enterprises, seeking to enhance the performance and wellbeing of their employees in the era of the pandemic. Similarly, scholars can benefit from theoretical premises of current study and the potential pathways for future analyses. (shrink)

A recent experiment performed by S. Afshar [first reported by M. Chown, New Sci. 183:30, 2004] is analyzed. It was claimed that this experiment could be interpreted as a demonstration of a violation of the principle of complementarity in quantum mechanics. Instead, it is shown here that it can be understood in terms of classical wave optics and the standard interpretation of quantum mechanics. Its performance is quantified and it is concluded that the experiment is suboptimal in the sense (...) that it does not fully exhaust the limits imposed by quantum mechanics. (shrink)

Shahriar S. Afshar claimed that his 2007 modified version of the double-slit experiment violates complementarity. He makes two modifications to the standard double-slit experiment. First, he adds a wire grid that is placed in between the slits and the screen at locations of interference minima. The second modification is to place a converging lens just after the wire grid. The idea is that the wire grid implies the existence of interference minima, while the lens can simultaneously obtain which-way information. (...) More recently, Cramer argued that the experiment bolstered the Transactional Interpretation of Quantum mechanics. His argument scrutinizes Bohr’s complementarity in favor of TIQM. We analyze this experiment by simulation using the path integral formulation of quantum mechanics and find that it agrees with the wave-particle duality relation given by Englert, Greenberg and Yasin. We conclude that the use of Afshar’s experiment to provide a testbed for quantum mechanical interpretations is limited. (shrink)

It has been claimed that this result constitutes a violation of the Principle of Complementarity. This paper discusses the implications of this experiment and considers how Cramer's Transactional Interpretation accomodates the result. It is shown that the Afshar experiment is isomorphic in key respects to a a spin one-half particle prepared as (...) ``spin up along x'' and post-selected in a specific state of spin along z. It is concluded that Bohr would have had no more problem accounting for the Afshar result than he would in accounting for the aforementioned pre- and post-selection spin experiment, in which the particle's preparation state is confirmed by a nondestructive measurement prior to post-selection. A modified version of Young’s experiment by Shahriar Afshar indirectly reveals the presence of a fully articulated interference pattern prior to the post-selection of a particle in a “which-slit” basis. While this experiment does not constitute a violation of Bohr’s Complementarity Principle as claimed by Afshar, both he and many of his critics incorrectly assume that a commonly used relationship between visibility parameter V and “which-way” parameter K has crucial relevance to his experiment. It is argued here that (...) this relationship does not apply to this experimental situation and that it is wrong to make any use of it in support of claims for or against the bearing of this experiment on Complementarity. We respond to criticism of our paper “Paradox in Wave-Particle Duality for Non-Perturbative Measurements”. We disagree with Steuernagel’s derivation of the visibility of the Afshar experiment. To calculate the fringe visibility, Steuernagel utilizes two different experimental situations, i.e. the wire grid in the pattern minima and in the pattern maxima. In our assessment, this procedure cannot lead to the correct result for the complementarity properties of a wave-particle in one particular experimental set-up.

O experimento de Afshar foi proposto recentemente como sendo uma violação do princípio de complementaridade. Reconhecendo a novidade trazida pelo experimento, argumentamos que ele permite um refinamento de tal princípio, a partir do estabelecimento de dois pontos: (1) a possibilidade de modificar o "tipo" de fenômeno (onda ou partícula) sem alterar o estado quântico, e (2) a constatação de que o tipo de fenômeno, associado a um quantum detectado, refere-se a um trecho determinado percorrido pelo objeto quântico. O primeiro (...) ponto é explorado em interferômetros de Mach-Zehnder, com dispositivos de polarização e na montagem dupla de Unruh. O segundo ponto salienta que um fenômeno pode ser corpuscular com respeito a uma região e ondulatório com respeito a outra, estando a novidade de Afshar na proposta de uma maneira de constatar ambos simultaneamente. A restrição (1) acaba tendo um efeito desprezível no experimento de Afshar. Afshar's experiment was recently proposed as a violation of the principle of complementarity. Acknowledging the novelty brought by the experiment, we argue that it allows a refinement of this principle, with the establishment of two points: (1) the possibility of modifying the "type" of phenomenon (wave or particle) without changing the quantum-mechanical state, and (2) the recognition that the type of phenomenon, associated to a detected quantum, refers to a specific region traversed by the quantum object. The first point is explored in Mach-Zehnder interferometers, with polarization devices and in Unruh's double setup. The second point emphasizes that a phenomenon can be corpuscular with respect one region and undulatory with respect to another. Afshar's originality lies in his proposal of a way of ascertaining both simultaneously. Restriction (1) turns out having a negligible effect in Afshar's experiment. (shrink)

We discuss the multiple pass interferometer setup proposed by Unruh, and clarify some of the fundamental issues linked with complementarity. We explicitly state all mathematical instructions for manipulating the quantum amplitudes and assessing the probability distribution functions. In this respect we show that certain purely math logical limitations (requirement for consistency) prevent one to argue that there is one-to-one corespondence between paths 1 and 2 and the exit gates 10 and 9 ("which way" interpretation), and at the same time insist (...) on pure state density matrix, i. e. existent nonmeasured interference in the second building block of Unruh's interferometer. Furthermore one cannot even argue that Unruh's setup is described by mixed density matrix that keeps the one-to-one correspondence between the paths 1 and 2 and the exit gates. This last claim is mathematically consistent, however is experimentally disprovable - because one may potentially distinguish mixed quantum state from pure quantum state. One just lets the two beams captured at the exit gates cross each other. If interference can be observed the two exit gates were coherent and provide beams in pure state (superposition), while if interference cannot be observed, the state of the exit gates was mixed one. Since the captured beams at the exit gates in Unruh's experiment could interfere this implies that the whole setup is characterized with pure state density matrix and does not preserve the one-to-one correspondence between the entry points and exit gates, even in case where the destructive interference in arm 5 of the interferometer is not measured. Therefore the correct (experimentally plausible and mathematically consistent) exposition of complementarity introduced by Georgiev in 2004 is that Unruh's setup is characterized by pure state density matrix and does not keep the suggested by Unruh one-to-one correspondence. As an appendix is shown the equivalence between Unruh's setup and Afshar's setup and correct analysis of Afshar's experiment is also provided. (shrink)

Afshar et al. claim that their experiment shows a violation of the complementarity inequality. In this work, we study their claim using a modified Mach-Zehnder setup that represents a simpler version of the Afshar experiment. We find that our results are consistent with Afshar et al. experimental findings. However, we show that within standard quantum mechanics the results of the Afshar experiment do not lead to a violation of the complementarity inequality. We show that their claim (...) originates from a particular technique they use to analyze their results. In their analysis, they assume a classical concept, that particles have a definite trajectory before detection, thus, they obtain which-way information by particle detection plus path extrapolation by applying momentum conservation. This analysis technique is standard in experimental particle physics. Important discoveries such as the detection of vector bosons have been made through the application of this technique. We note that particle detection plus path extrapolation is a suitable technique within de Broglie-Bohm theory of quantum mechanics. (shrink)

The assertion that an experiment by Afshar et al. demonstrates violation of Bohr’s Principle of Complementarity is based on the faulty assumption that which-way information in a double-slit interference experiment can be retroactively determined from a future measurement.

Over the last quarter of a century, English medical law has taken an increasingly firm stand against medical paternalism. This is exemplified by cases such as Bolitho v City and Hackney Health Authority, Chester v Afshar, and Montgomery v Lanarkshire Health Board. In relation to decision-making on behalf of incapacitous adults, the actuating principle of the Mental Capacity Act 2005 is respect for patient autonomy. The only lawful acts in relation to an incapacitous person are acts which are in (...) the best interests of that person. The 2005 Act requires a holistic assessment of best interests. Best interests are wider than ‘medical best interests’. The 2018 judgment of the Supreme Court in An NHS Trust v Y from patients in prolonged disorders of consciousness ) risks reviving medical paternalism. The judgment, in its uncritical endorsement of guidelines from various medical organisations, may lend inappropriate authority to medical judgments of best interests and silence or render impotent non-medical contributions to the debate about best interests—so frustrating the 2005 Act. To minimise these dangers, a system of meditation should be instituted whenever it is proposed to withdraw life-sustaining CANH from patients with PDOC, and there needs to be a guarantee of access to the courts for families, carers and others who wish to challenge medical conclusions about withdrawal. This would entail proper public funding for such challenges. (shrink)

The extent to which English law remedies injury to autonomy as a stand-alone actionable damage in negligence is disputed. In this article I argue that the remedy available is not only partial and inconsistent but also gendered and discriminatory against women. I first situate the argument within the broader feminist critique of tort law as failing to appropriately remedy gendered harms, and of law more broadly as undervaluing women’s interest in reproductive autonomy. I then show by reference to English remedies (...) law’s first principles how imposed motherhood cases—Rees v Darlington and its predecessor McFarlane v Tayside Health Board—result in gender injustice when compared with other autonomy cases such as Chester v Afshar and Yearworth v North Bristol NHS Trust: A minor gender-neutral ITA is better remedied than the significant gendered harm of imposing motherhood on the claimant; men’s reproductive autonomy is protected to a greater extent than women’s; women’s reproductive autonomy is protected by an exceptional, derisory award. Worst of all, courts refuse to recognise imposed motherhood as detriment; and the deemed, mansplained, nonpecuniary joys of motherhood are used to offset pecuniary upkeep costs, forcing the claimant into a position she sought to avoid and thus further undermining her autonomy. The recent Singaporean case ACB v Thomson Medical Pte Ltd, awarding compensation for undermining the claimant’s genetic affinity in an IVF wrong-sperm-mix-up demonstrates some improvement in comparison to English law, and some shared gender injustices in the context of reproductive autonomy. ACB’s analysis is oblivious to the nature of reproductive autonomy harm as gendered; and prioritises the father’s interest in having genetic affinity with the baby over a woman’s interest in not having motherhood imposed upon her. In modern law medical paternalism no longer rules. Respect for patient autonomy is now a fundamental principle of both medical law and bioethics. As a result of these developments, and cases such as Rees v Darlington Memorial NHS Trust and Chester v Afshar, there have been suggestions that the law of clinical negligence should be developed so as to recognise diminished autonomy as a form of actionable damage in this area of tort law. Yet in order for the tort (...) of negligence to recognise this new interest, it is first necessary to determine how autonomy should be understood in this context. The purpose of this article is to shed light on this issue and arrive at a suitable definition of the concept. After outlining the different theories of autonomy it is argued that the traditional liberal definition is the most philosophically and legally coherent. (shrink)

This commentary provides a brief overview of the methods and results presented by Jennifer Kuzma, Pouya Najmaie, and Joel Larson in “Evaluating Oversight Systems for Emerging Technologies: A Case Study of Genetically Engineered Organisms.” It offers suggestions regarding how supplemental information might be used to gain additional insights into the authors' results and how future research could further enhance our understanding of the attributes and outcomes of regulatory oversight for genetically engineered organisms.
